SCOTUS Takes Up Case Challenging 80% Receiver Rule
Once again, a lawsuit against a rule made by the ATF is headed to the Supreme Court of the United States (SCOTUS). Garland v. VanDerStok challenges the ATF’s administrative rule that declared firearm kits and partially-manufactured receivers were firearms. This follows hot on the heels of oral arguments in Cargill, the case fighting the bump stock ban.
Analysis: District Court Vacates ATF 80% Receiver Rule
The hits just keep on coming in the lawsuits against the Bureau of Alcohol, Tobacco, Firearms, and Explosives. ATF took their most recent L on June 30th in the case VanDerStok v. Garland in the Northern District of Texas (case number 4:22-cv-00691-O). Let’s go through this decision, what it means, and what it may signal for other issues.

The internet has been abuzz with discussions of the new ATF “receiver rule,” which became effective on August 24, 2022. Most of that conversation has focused on changes that affect the so-called 80% receivers. However, this regulation made changes in other areas as well. Let’s take a look at how this rule will work.
New CYPHERX-ZERO SCAR 17s Compatible Receiver
Have you ever wanted to make your own SCAR 17s? Me neither but maybe I do now. The folks over at Imperial Arms Co. have just made their CYPHERX-ZERO receiver available to the public and this receiver requires no FFL to purchase. This “Zero Percent Blank” (basically an 80%) was approved by the ATF back in April of 2021 and now Imperial Arms is more than happy to offer customers a shot at building out their own SCAR 17s using one of their receivers.
80% Arms Introduces GST-9 Modular Polymer 80% Pistol
Home gun builders have long enjoyed assembling or modifying AR-15s and other firearms. The AR platform’s modularity has been one of its top selling points for years. It’s relatively easy for the layman to order most components and put them together or swap them out without needing too many specialized tools or formal gunsmithing training. This homebrewing trend has given rise to another, more in-depth assembly practice: turning unfinished “80%” parts into functional firearms. This has been most prevalent with AR lowers, which is considered to be the serialized “firearm”, even without all of the other pieces required to make it function. After ARs, polymer pistol frames (a la Glock) are the next most common 80% item. California-based company 80% Arms uses these DIY-oriented products as the focus of their business, and with a July 16th press release, they have announce their newest offering. Meet the GST-9, a complete handgun kit that builds off of their previously-announced frame. The release reads:

Strike Industries first introduced these 80% polymer Glock frames back in January, at SHOT Show 2020. These frames are manufactured by Polymer80, however, they feature some ergonomic and aesthetic changes that set them apart from Polymer80’s own frames. Homemade Assault Rifles Found in Traffic Stop in Tennessee
During a routine traffic stop, a man from Tennessee was caught transporting two illegal homemade fully automatic assault rifles. While that sounds like the leader for a poorly written article about perfectly boring semiautomatic assault rifles, in this case it is accurate! Among other (apparently legal) weapons, two rifles, complete with three-position selectors and auto sears, were seized from the vehicle of one Scott Edmisten, who was stopped after driving 25 miles an hour over the speed limit on a suspended license.

Listen, I want the NFA repealed, the 1986 ban on new machine guns abolished and complete firearms freedom as much, if not more, than any other flag-waving American.
